Exceptional Circumstances

During the COVID-19 pandemic, the Aged Care Quality and Safety Commission has temporarily modified our Regulatory Program, including the suspension of site audits to determine whether to accredit, not to re-accredit or vary the periods of accreditation for a service. 

In order to give effect to continuity of accreditation the Department of Health has, under Section 42.5 of the Aged Care Act 1997, made a decision to grant ‘exceptional circumstances’ to this service until 21 June 2022.

The service remains subject to compliance monitoring by the Aged Care Quality and Safety Commission.

Compliance update

Following an assessment contact conducted on 26 February 2020, the Commission made a decision that improvements have been made to the service to ensure that the Aged Care Quality Standards are complied with.

Following a site audit the Commission made a decision on 13 December 2019 that this service met one of the eight Aged Care Quality Standards. The service is re-accredited for one year until 21 December 2020.

Following an audit we decided that this home met 32 of the 44 expected outcomes of the Accreditation Standards and would be accredited for one year until 21 December 2019.

Following an audit we decided that this home met 23 of the 44 expected outcomes of the Accreditation Standards. We decided to vary this home’s accreditation period. This home is now accredited until 21 December 2018.

Serious risk decision

On 2 July 2018 a delegate of the CEO of the Australian Aged Care Quality Agency made a decision that failure by Empowered Living Support Services Ltd to meet one expected outcome in the Accreditation Standards in relation to Bethel Aged Care Facility has placed the safety, health or wellbeing of care recipients of the service at serious risk.

An assessment contact was conducted by the Aged Care Quality and Safety Commission on 22 January 2019 to 23 January 2019 at Bethel Aged Care Facility to monitor the service’s progress. The Commission found the service complies with all Accreditation Standards.

Serious risk is not an ongoing state; it is a statutory decision based on evidence at a point in time.

Following an audit we decided that this home met 44 of the 44 expected outcomes of the Accreditation Standards and would be accredited for three years until 12 January 2020.
