There are no changes to the Code under the new Aged Care Act. Only the language has been updated about who the Code applies to. The Code of Conduct for Aged Care describes how aged care providers, responsible persons, and workers (including volunteers) must behave and treat people receiving aged care.
It helps ensure that people can have confidence and trust in the quality and safety of aged care they receive.
The Code:
- supports a person's right to personal choice, dignity and respect
- promotes kind, honest and respectful behaviour
- keeps people receiving aged care safe from harm.

Requirements during the transition
Requirements to comply with the Code of Conduct will continue after Transition Day.
If a provider must comply with a Code of Conduct requirement under the old law, they must still comply after Transition Day. These requirements continue if the provider is deemed a registered provider on Transition Day.
If a provider must take action to comply with the Code of Conduct and they don’t do so by Transition Day, or the period for taking this action is after Transition Day, they will still be required to take action.
If a provider doesn’t comply with the requirement, we will consider using required action notices or Commissioner-imposed conditions.
